Minimum Recruitment Requirements:
Before you apply for a Labour Market Impact Assessment, you must conduct at least three different recruitment activities to:
- Advertise on the Government of Canada’s Job Bank. As of August 28, 2017, all employers, regardless of province or territory, will be required to advertise on Job Bank. If, for whatever reason, you choose to use an alternative method, you must submit a written explanation with your rationale and reasoning of the alternative method.
- Conduct at least two additional methods of recruitment consistent with the occupation. This must target an audience that has the appropriate education, professional experience and/or skill level that is required. As of August 28, 2017, if you are from a province or territory with a provincial or territorial job board, you will be required to use Job Bank, but will be able to use a provincial or territorial job board as an additional method of recruitment.
- One of the recruitment methods used must be on a national scope, and easily accessed by residents of any province or territory in Canada, as people who hold high-wage positions are willing to re-locate for employment. Canadians and permanent residents must have the capacity to search for advertisements in various locations across Canada on a single site as opposed to sub-sites.
Job Advertisement Duration:
You must ensure that your job advertisement:
- Occurred three months prior to submitting a LMIA application.
- Has been up for four consecutive weeks within the three months of submitting an LMIA application.
In order to ensure a positive outcome for a Labour Market Impact Assessment application, at least one of the three recruitment activities to seek qualified Canadians and permanent residents must be ongoing until the date of a positive (or negative) outcome for the application has been issued.
Job Advertisement Information:
In your job advertisement please include:
- Company operation name
- Business address
- Title of position
- Job duties (for each position, if advertising for more than one)
- Terms of employment (project based, permanent position, etc)
- Language of work
- Wage (must include incremental raises, performance pay or bonus); it is important to note that a wage range can be used for the purposes of satisfying advertisement requirements. The minimum wage in the range must meet predominant wage.
- Benefits package (if included)
- Location(s) of work (local area, city or town)
- Contact information: telephone number, cell phone number, email address, fax number or mailing address
- Skills requirements: including education and work experience
Proof of Advertisement
You must be able to demonstrate your efforts in recruiting qualified Canadian residents, as well as permanent residents, by providing these documents as proof of recruitment with your application:
- Copy of advertisement and information to support where, when and for how long the position was advertised
- Proof that printed media and websites were used to advertise to targeted audience that has the appropriate education, professional experience or skill level required for the position
- Proof of other recruitment activities; for example, an invoice from a job fair
